Are the bane of modern living.

Can you sell photos taken at gigs? I looked into the IPR of photo and film a while back and the answer would be yes with a few exceptions. You can certainly sell to publishers, and news/photo agencies and you can probably sell individual prints of photographs.

The issue is if you made a product that could be considered endorsed by the artist such as a poster, t-shirt, novelty mug, meat pies or some such. Then you may have to pay royalty to the artist for using there image. This is solely because they are famous and their image itself has a value and could be considered a trademark. So the arguments against you are those arounf trademark infringement rather than copyright or permission. You would not have to do this with photos taken from a public place in the UK. As you had permission to be at the gig you did not trespass but if there are any terms and conditions placed on your press pass entry then you may be bound by them.

The UK laws are stacked on the side of the photographer.

has the best and most definitive guidance I have been able to find.

Hope this helps

Yeah - I'm reaching the conclusion that I have the "legal rights" but I have to balance that against pissing people off and never getting a pass again!

But we shall see. In parallel with exploring the law I'm exploring talking to the bands.
