How long have you been working for them?

Do they have an employee's handbook?

sorry, work hat firmly on head. It will depend on how long you've been employed etc. but that strikes me as distinctly unfair.

No. That requires some level of organisation by the company.

I've always known they're a poor company but wasn't expecting this..

How long precisely i.e. what's your start date, and how much holiday did you have.

If that makes 12 months then you could be able to look at unfair dismissal.

Arm yourself with:

Your contract - either the copy of the one they had to by law give you. If you didn't, write down what you believed your job role to be.

Records of any meetings you have had regarding performance.

Go to the CAB and seek advice regarding unfair dismissal.

My start date was the end of October last year. It is just under 12 months. I never was given a copy of my contract, and my brain is so muddled at the moment I'm having difficulty remembering whether I had one or not, I don't think Idid as Lynn was saying the other day how she doesn't have one..

There were never any official meetings regarding performance. Charlotte told Lynn over the phone she was worried about my sales once, when I first started, which Lynn told me and then on saturday charlotte came into the shop for a suprise inspection and spoke to me about the tidiness of the shop - which she admits is nothing to do with my losing the job.

Unfortunately, with under a year, it gets difficult.

You should however have been provided with a contract, no matter what the job.

They should be able to provide a solid reason for firing you, even with the time period though.

Pool all your information and hie thee to the CAB.

I have just been informed that new employment regulations have come into effect from 01/10/2005. Basically:

a: if you include your holiday entitlement then there's a chance that you've actually been employed the full 12 months. If the holiday entitlement you have left adds up and takes you over the 12 month mark, we're rocking.

b: if they have disregarded the disciplinary procedures under the ACAS guidelines, then under the new employment legislation this could be automtically unfair.

If you don't have a contract then check to see if the other employees in the shop have one. If not then this company is breaking the law.

Please, trust me, go to the CAB :o)

Having had to look at this from the other direction to Kath, I agree with what she's saying.

I suspect it's quite possible that they don't want to keep people for too long, since then they have the worry of things such as redundancy pay.

Additionally, from staff turnover, they can ensure that they don't have to give payrises.

From memory, I believe you've been working for them for 14/15 months?

less than that, just under 12 as I was down for a couple of months job hunting before getting the job.
