The child would "earn the right" by being a "good" student. By learning the material, by being decently behaved, etcetera. Failing that, they are dragging the rest of the class down.
There is a *giant* difference between corporal punishment and abuse. Wearing a dunce cap when the child misbehaves discourages the behavior. the same applies to the purely emotional bullying. Call a kid a fag and you get to do the peter panda dance in front of the class, or failing that, 5 thwacks with a switch, or failing that, go home. Don't come back. As evidence that this sort of thing works, I will point you to the ever-increasing crime rates and declining educational standards since these measures were abandoned.
The problem with your "restraining orders" notion is... look, it's a plain fact that you can't expect kids to behave as adults. The whole point of schools is to teach them to do taht very thing. So, the teaching systems do have to include provision for boys being boys. I agree that allowing it to become systemic is inexcusable, but it is equally unreasonable to destroy lives over minor infractions by preteens.
