I WON!!!
Well, I had my Disability/SSI appeals hearing today, Tuesday, Dec. 9, 2008, and I won!! My lawyer pointed out to the current judge that not only did the previous judge make his ruling with insufficient information, but also used the wrong statutes to do so! After answering questions to both my lawyer and the judge, we all listened to testimony from medical and employment assesment experts. The assesment expert stated that with all the restrictions placed on me by my doctors, there is no way I could get and keep a job.
When my lawyer, my case manager and I left the courtroom and went into the briefing room, my lawyer said, "You got it."
I said something like, "It looks that way", and he said, "No 'looks that way', you got it. The employment assesment specialist said you can't work, so, you won."
He also told me that while I still have to wait for the officail ruling from the judge, sometimes the first check comes before the ruling does. I hope it comes soon, I have bills to pay and it would be very nice to have a car for Christmas. I hope I get all the retro-active pay for 5 years that I should have coming, too because then I can apply to finance a house. I'm so happy!!
