whatever happened with it being an illegal apartment? what's wrong with your apartment anyway? Why can't you give him 60 days notice? And yes you can pretty much kiss your deposit goodbye.

plus say the desposit was a months rent (which it shouldnt be any MORE than that)

if you stay there and pay it youre miserable.

if you move toa new place, youre out and lose the deposit but are happy.

same $$ amount but beingsomewhere else.
