Fraud vs armed robbery of a bank, and the guy had priors.
So, the other facts matter.
Should the businessman have gotten more? Yep. Then again, why isn't Rangel in prison, as one of us would be if we had committed crimes like his?

The lesson here seems to be: if you're going to commit a crime, go for broke. Being part of a $3 billion fraud only gets you 40 months, so you might as well; $100 gets you 15 years, so you might as well go bigger. Much bigger!
