Taking care of business

First, I want to assure everyone that, though this journal is just created, I'm not a troll or wanker.  I've had no use for an LJ before and will probably delete it after all this mess is over.  However, people I know and care about have been/are being hurt by LJ/6A and I'm a vindictive bitch!  I've been seeing a lot of posts regarding reporting LJ ( Read more... )

All well and good, however, LJ/SA is claiming they aren't ads, they are sponsors. (Yea I know... what's the difference.)

Doesn't matter what LJ/6A claim. What matters is what the AG thinks about it, and I doubt that he will agree with LJ/6A.

I do wish you luck with this, and I hope the AG of Calif. see's it your way. It would be a big blow to SA/LJ.

I see it as an iffy call since 'ads' are not popping up as they do on other sites. The AG may say since the 'sponsored layouts and V-gifts' are optional and not forced upon users they are not in breach of the the TOS.

The dictionary definition of sponsor that applies here is: a person, firm, organization, etc. that finances and buys the time to broadcast a radio or television program (in this case, finances 6A's operating costs) so as to advertise a product. Sponsor = advertiser. Since everyone who looked at the LJ news page was subjected to this 'sponsorship', I expect the AG will consider it advertising.

They are OPTIONAL no one is forced to use them if someone sends one that is their choice. Now if the Pepsi logo appeared on my layout without it being my choice for it to be would be a different matter.

Like the OP said, it doesn't matter what LiveJournal says. A sponsor in this case is an advertisement. They pay to be able to put their name out there and advertise. It's like all of those shows you watch that say "All My Children is brought to you by...Pampers..." They're ads.

(Um, not that I watch All My Children...anymore... >_____>)
