well it has been decided......i am getting a dream application asap........cuz yeah ............i am going crazy.....well i am at home already...got sent home during mrs goodwins class.grrg she makes mistakes...but dont we all anywho... i was written up for my 6th tardy...and thats fine no mistakes by her she puts the refferal on my desk...i put it under my desk and continue working...she gets in again and says will u please come with me and i say why she says i need to talk with you and i said i dont wanna talk to you she say will you please come out in the hall i said no...then mr yanci and carl come in and say will you come with us i said why they said b/c you have a refferal for your sixth tardy i said ok i got up they said bring your stuff and i got my stuff mrs goodwin says leave your work for my class (likely of her forcing me to fail) so i simlpy drop it on the floor carl says pick that up right no.. i say no mr yanci says pick it up now i said no thanx...carl says your gonna pick that up i said im sorry but i am not...i start to leave carl puts his hands one on my sholder(right) and one on my fore arm (left)as i am leaving ...when he does this i take one step back and say excuse me sr but i think you have no reasons for restraining mehe takes his hands off and says i was not forcing you to do any thing this whole class is my witness...wich made no sense then they mention that by not picking up the paper i am disrupting class i say well if thats what you want to happen i guess it will...then they tell me to pick up the paper again ...i mention that i am not disrupting anything they are the ones who are standing in the door not letting me leave the classroom justin says sumthin about me disrupting the class...mrs goodwin of course gripes athim(he was trying to help me make a different desision and get in less trouble,but mrs goodwin wants me in trouble cuz she is twofaced)i plainly state one more time ...the paper is on the floor ..if you want it so badly simply pick it up i on the other hand will not..on the issue of disrupting the class...they are still working and we would not be in the class if you would realize the paper on the floor is not that big of a deal ...they give me one last chance before they arrest me for disorderly conduct..i say if thats what you think you need to do then do it ....in the end i get written up by mryanci for .....CLASS DIRUPTION /EXCESSIVE TALKING.....DISOBIDIENT DISRESPECTFOR AUTHORITY......DISRESPECT FOR AUTHORITY...EXCESSIVE TARDINESS....INSUBORDINATION..REFUSAL TO DO AS THE INSTRUCTOR ASKED(PICK UP PAPER)..then i get a disorderly conduct warning..
i looked up penal code 42.01 disorderly conduct...and i did not do any thing to break that code so tomarrow..mrs myrak..me and mr yanci are gonna have a lil talk aboot that an the better un warn me or i will do the same thing and get arrested for the wrong thing ......being disorderly conduct becauseDIRUPTION /EXCESSIVE TALKING.....DISOBIDIENT DISRESPECTFOR AUTHORITY......DISRESPECT FOR AUTHORITY...EXCESSIVE TARDINESS....INSUBORDINATION..REFUSAL TO DO AS THE INSTRUCTOR ASKED(PICK UP PAPER).. has nothing to do with disorderly conduct according to penal code 42.01 which states§ 42.01. DISORDERLY CONDUCT. (a) A person commits an
offense if he intentionally or knowingly:
(1) uses abusive, indecent, profane, or vulgar
language in a public place, and the language by its very utterance
tends to incite an immediate breach of the peace;
(2) makes an offensive gesture or display in a public
place, and the gesture or display tends to incite an immediate
breach of the peace;
(3) creates, by chemical means, a noxious and
unreasonable odor in a public place;
(4) abuses or threatens a person in a public place in
an obviously offensive manner;
(5) makes unreasonable noise in a public place other
than a sport shooting range, as defined by Section 250.001, Local
Government Code, or in or near a private residence that he has no
right to occupy;
(6) fights with another in a public place;
(7) discharges a firearm in a public place other than a
public road or a sport shooting range, as defined by Section
250.001, Local Government Code;
(8) displays a firearm or other deadly weapon in a
public place in a manner calculated to alarm;
(9) discharges a firearm on or across a public road;
(10) exposes his anus or genitals in a public place and
is reckless about whether another may be present who will be
offended or alarmed by his act; or
(11) for a lewd or unlawful purpose:
(A) enters on the property of another and looks
into a dwelling on the property through any window or other opening
in the dwelling;
(B) while on the premises of a hotel or
comparable establishment, looks into a guest room not the person's
own through a window or other opening in the room; or
(C) while on the premises of a public place,
looks into an area such as a restroom or shower stall or changing or
dressing room that is designed to provide privacy to a person using
the area.
(b) It is a defense to prosecution under Subsection (a)(4)
that the actor had significant provocation for his abusive or
threatening conduct.
(c) For purposes of this section:
(1) an act is deemed to occur in a public place or near
a private residence if it produces its offensive or proscribed
consequences in the public place or near a private residence; and
(2) a noise is presumed to be unreasonable if the noise
exceeds a decibel level of 85 after the person making the noise
receives notice from a magistrate or peace officer that the noise is
a public nuisance.
(d) An offense under this section is a Class C misdemeanor
unless committed under Subsection (a)(7) or (a)(8), in which event
it is a Class B misdemeanor.
(e) It is a defense to prosecution for an offense under
Subsection (a)(7) or (9) that the person who discharged the firearm
had a reasonable fear of bodily injury to the person or to another
by a dangerous wild animal as defined by Section 822.101, Health and
Safety Code.
