Yes. Cyclops was killed off 2 minutes into X3 because James Marsden was appearing in Superman and Brett Ratner felt this was a betrayal - but Marsden was in both X1/2/3 and Superman 5.

More likely, in both cases they would simply ignore all previous movies and make a new one from scratch - like how Batman Begins completely ignored all the previous Batmans, and how Casino Royale was out of continuity with other Bond movies, etc.

I don't recall where I heard this, but if they did a JLA movie, they'd be pulling together a whole new cast. None of the current folks would be in it. Sadly, too, since I think Bale's Batman is pretty darned good, barring the marbles-in-his-voice Batman voice.
Of course, as you say, it's moot if he dies.
Take the Ed Norton Hulk, for example - the origin story is covered, entirely, in the opening sequence, and the movie tells the story from there without bothering to introduce the characters further

More likely, they'll be in the same boat as Marvel with Spiderman, The Punisher, The Fantastic Four, Daredevil, and a couple of others: They sold the rights to make movies with those characters, and as long as anyone is making a ton of money with comic book movies, those rights are NOT coming home until they're absolutely required to.
It's like how DC has maintained the rights to Watchmen: The deal is that as soon as Watchmen goes out of print, all rights to the product and all characters revert to Alan Moore. DC's been screwing him out of money and control for *decades* simply never letting it go out of print. They did money-losing print runs for years as an investment to ensure that the book stayed with them, on the theory that the critically acclaimed extremely-popular comic that's considered "among the best ever" was a good idea to hold on to for the peanuts that a small print run costs.
