One of the stories behind this is that the JCS really, really wanted a legislative fix to DADT, because that way *they kept control of the process*. They could see the courts writing on the wall, and recognized that repeal by court fiat (as opposed to legislative fiat) would put someone not them in control. This way, they can footdrag, whine, pout, study, and otherwise generally dither and delay

I was under the impression that the courts had already mandated a stop to discharges.
