I was the previous poster who deleted her entry.. I apologize. I didn't mean to upset anyone or cause a ruckus. I felt bad because I found out that the security deposit check was supposedly sent. However there is a new problem, so I will start at the beginning and re itterate what was deleted. Again, I'm sorry.

It states in my lease that a tenant shall recieve their security deposit refund within 30 days of vacancy and that it is state law.

However, we're now on day 33 and still no check. I realize we moved from PA to MN, so I figured I'd just call my landlord to see what was up this morning. I was told (by the landlord) that they changed their policy and I wouldn't be seeing that money for another one to two months. Furiously I asked why it was changed and why we were never told. And she said I'd have to take it up with the Coorporate office in NJ. So I did. Not getting an answer this morning because they will be out until Tuesday. This is when I posted last time.

About 10 minutes later I recieved a call from the assistant of the person I was trying to call. She stated that my previous land lord had no idea what she was talking about and that our check was in the mail (and was put in the mail a week ago). She gave me the certified mail # (so I could track it and find out when I could go get in from the post office, because I'd need to sign for it) and wished me a good weekend. This was when I deleted my previous post. I thought all was solved.

But.. oh was I wrong. The tracking number isn't working, I called the gal at the Coorporate office back and made sure that the number was correct, it was. So, I called USPS and that woman stated that if the number wasn't working it was never put in the system. WTH. Again I called the Coorporate office back, but this time no one answered, I left a message, but never recieved a phone call. So, now what do I do? Wait til Tuesday I suppose, but I'm guessing I'm going to get the run around and the check will be missing, if so what happens? Do I need to get an attourney?

tisiphone: If it really is a state law, you need to consult PA's landlord-tenant laws to find out what to do about this. It is possible there is a tenant advocate that can do something about this. It is also possible that you will have to take them to small claims court.


m0rbidm00n: I'm not sure about PA, but in some states the 30-day rule is actually a law. Look into this. If if is, and they haven't refunded you by that 30 days, you can sue them for the entire refund, because after 30 days they have no legal recourse to take any part of it from you.
