With Past Imperfect Part 2

[Jump to APARTMENT.]

LYLE:
I don't want to rule the world. I just want to pass this class.

KIMIKO:
So you can get into grad school.

LYLE:
Precisely.

KIMIKO:
So you can get a Master's degree.

RICHARD:
And eventually a Doctorate.

KIMIKO:
Or maybe so you can be hired by some mega-powerful company.

RICHARD:
Where you'll subsequently be promoted through the ranks--

KIMIKO:
Until you're in a position from which you can take over the world.

LYLE:
(GROANS) I just want to pass this class.

KIMIKO:
Seriously, I think world domination is inevitable. I mean, it's a good thing we're such nice people. This class is teaching us to use our minds as weapons. In this day and age, computers control everything. We, my friends, control everything.

LYLE:
Don't get carried away, Kimi. There's still laws and stuff.

KIMIKO:
Don't talk to me about the law, Lyle. I know all about the law. You--don't.

[Jump to OFFICE.]

TOM:
Oh, this gal sounds like a peach.

WHIT:
What did she mean by that?

RICHARD:
Kimiko is rather proud of the fact that she used to steal things--she'd break into homes of people she didn't like and take money, jewelry, any small valuables they had lying around.

TOM:
Did she ever get caught?

RICHARD:
Once. They let her off easy. She brags about it all the time.

WHIT:
She's proud of it?

RICHARD:
Shameless.

WHIT:
I see. Does she know about your brushes with the law?

RICHARD:
No. I . . . haven’t told anyone. One kid in class, Dominic Spinnard, he's real good at finding things out, and somehow he knew about me. He once tried to blackmail me into paying him some monthly fee for keeping his mouth shut. I said I didn't care and he didn't follow through. He's sort of a rival of me and my friends--well, mostly with Lyle. Spinnard’s quite good with computers--especially good at copying programs. If he sees how it runs once, he can program it by hand almost identically. We’re all a little jealous of that. Oh yeah, Dominic got mentioned at dinner, too.

[Jump to APARTMENT.]

KIMIKO:
I bet Spinnard is slaving away over his program right now, instead of having a relaxing meal with friends.

LYLE:
Ugh, don't mention Dominic. His programs are perfect.

KIMIKO:
Fine, I won't. (A BEAT) Lyle, if you were going to hack into a company's computer system for salable data, how would you go about it?

LYLE:
Me? I, uh . . . I don't know.

KIMIKO:
Fine. Richard?

RICHARD:
I wouldn't.

KIMIKO:
You two are no fun at all. Know what I'd do? I wouldn't bother hiding where I was coming from. I'd just come from someone else's computer.

[Jump to OFFICE.]

WHIT:
Wait--she talked about hacking into other systems over dinner? The night you were arrested.

RICHARD:
Yeah.

WHIT:
That seems odd.

RICHARD:
It would have, if she wasn't always talking about it. That's about when they came.

[Jump to APARTMENT.]

KIMIKO:
Let them take the heat, you know? Why bother hiding?

[A knock on the door.]

RICHARD:
Be right back.

[Richard stands and goes to the door.]

LYLE:
You're too much sometimes, Kimi.

KIMIKO:
Too much? Too much what?

[Richard opens the door.]

QUINN:
Richard Maxwell?

RICHARD:
(HESITANT) Can I help you?

QUINN:
Captain Quinn, Odyssey Police. We have a warrant to search your apartment.

RICHARD:
You do.

KIMIKO:
(GASPS; EXCITED) Richard, what did you steal?

[Jump to OFFICE.]

RICHARD:
Nothing. I hadn't stolen anything, but after looking at my computer, they arrested me.

WHIT:
What did Lyle and Kimiko do?

RICHARD:
When they realized the police were taking me, they tried to say they knew I was innocent. But since neither of them had actually seen me on Monday night, the police didn't listen.

TOM:
I don't mean to badmouth your friends, Richard, but you think you could've been set up?

RICHARD:
(DOUBTFUL) By Lyle and Kimiko?

WHIT:
Kimiko was talking about how she would frame someone if she needed to. She might be the type of person who's bold enough to set things in motion and then talk about how she did it right as her plan is unfolding--she might think of it as an interesting challenge.

RICHARD:
I don't think she really means it when she talks about that kind of thing.

WHIT:
I know they're your friends, but we have to consider every possibility.

RICHARD:
Maybe. But not Lyle. The mere mention of breaking the law was making him cower.

TOM:
Help me figure this out. What would the motive be for stealing that computer from Campbell College? And why’d they set fire to it afterwards?

WHIT:
Well, the fire helped destroy any evidence.

RICHARD:
It’s also a good way to be sure the cops would pin it on me.

WHIT:
(AFFIRMATIVE SOUND). And as to the motive, my guess is, money. Captain Quinn suspects that someone hired you to steal the computer. Is Kimiko in need of money?

RICHARD:
Not that I know of. And she's never struck me as someone who would work for anyone else like that. All she really wants is recognition. All Lyle wants is a passing grade, and all I want is--well, never mind. The point is, none of us have a good enough reason to drive to Odyssey and break into Campbell College when we should have been working on our school projects. (A BEAT) You know, I should probably call her and Lyle tonight, just to let them know I'm okay.

WHIT:
Good idea. And I might pay them a visit--see if maybe their testimony can be useful to you. I'll see about contacting a good lawyer for you, too.

RICHARD:
Great. I really appreciate it.

[Richard stands.]

TOM:
You going somewhere?

RICHARD:
Well, to make those phone calls.

TOM:
You got a place to stay in town?

RICHARD:
Uh, sure. You know, my family lives here.

TOM:
Uh-huh. Well, you give us a call if you need anything.

RICHARD:
Will do!

[Richard leaves.]

TOM:
Well, what do you make of that.

WHIT:
I don't know.

TOM:
Do you believe him?

WHIT:
. . . yes.

TOM:
Good. I don't want to think I’m just being gullible.

WHIT:
You told me what he did while I was gone. It seems to me like he's stayed away from any criminal activity.

TOM:
I think he has. When I heard he'd been arrested, I sorta just knew it must've been some kind of mistake. But . . . well, one thing still makes me wonder. Why haven't we seen Richard in so long? What made him leave the hospital so suddenly? I visited him a few days in a row, but one day he'd just checked out and disappeared. No one's heard from him until now.

WHIT:
Well, maybe he'd done what he came here to do. You forgave him--maybe that was enough to clear his conscience so he could get on with the rest of his life.

TOM:
I like to think he wasn't here only to clear his conscience. It seems to me like he helped us out because he could--because it was the right thing to do. Why in the world would he leave as soon as things in Odyssey had settled down?

WHIT:
Why didn't you ask him?

TOM:
I don't know. There's a caginess to that boy, Whit. A part of him he doesn't want to show.

WHIT:
I noticed how reluctant he was to accept our help. Like he doesn't want us involved any more than necessary.

TOM:
Well, like it or not, we're involved. He called on you, and you're not about to just hand him over to some lawyer and a detective who doesn't believe him. Seems like Captain Quinn hasn't done all he can. Come to think of it, neither have I.

[Short musical transition to: SIDEWALK where Richard is walking.]

RICHARD:
Aha. Vacancies.

[Tom pulls up in his truck.]

TOM:
(CALLS) Hello there, stranger.

RICHARD:
Mr. Riley! What are you doing here?

TOM:
Well, I saw you about to enter this motel here, and thought you might prefer to stay somewhere more hospitable.

RICHARD:
You've already done too much.

TOM:
Nonsense. There's plenty of room at the Timothy Center.

RICHARD:
I couldn't.

TOM:
No? Well, I can't let you stay at a place like this in your own hometown. Get in the truck.

RICHARD:
No, really, it's okay.

TOM:
That's my line. It's okay, Richard. You're not going to be an inconvenience, or anything like that, so quit your excuses and get in the truck.

RICHARD:
I . . . well, all right.

[He does.]

RICHARD:
Thank you.

TOM:
You're welcome.

[Musical transition to: A HALLWAY at the Shepard’s. The Shepards and Tom are dining in the next room. Richard speaks to his lawyer on the phone.]

RICHARD:
If I do what?

LAWYER:
I said, if you can identify any accomplices, your sentence will be reduced greatly.

RICHARD:
I didn't have any accomplices. I didn't do anything wrong!

LAWYER:
Well, regardless, the only thing the jury is going to see is the computer evidence, and how this matches what you’ve done in the past. For-profit computer-related crimes, plus arson, isn’t that right?

RICHARD:
But I've never stolen anything--never broken in anywhere with the intent to physically steal something, anyway.

LAWYER:
. . . well, okay. (DOUBTFUL) I'll keep working on this for you, Mister Maxwell.

RICHARD:
Yeah, thanks.

[He hangs up.]

TOM:
(CALLS) Come have a seat, Richard.

[Richard enters the dining room.]

RICHARD:
Sorry about that.

ELLEN:
Oh, we understand.

BEN:
Go ahead and keep your phone on. It's important for you to be available at a time like this.

[Richard sits down.]

BETHANY:
Please pass the potatoes, Mister.

RICHARD:
Oh. Here you go.

[He does.]

BETHANY:
Thanks.

RICHARD:
You know, I really appreciate you inviting me to dinner and everything.

ELLEN:
It's nice to have you here, Richard.

AUBREY:
Did you say your name was Richard Maxwell?

RICHARD:
(HESITANT) Yeah.

AUBREY:
Hmm. That sounds familiar.

TOM:
Well, Richard helped me out a few years back. Risked a great deal to protect the truth. I only hope we can do the same for him now.

[Richard’s cell phone rings.]

RICHARD:
Oh--I'm sorry. I have to get this, it might be my lawyer again.

BEN:
Go ahead and take it.

RICHARD:
Excuse me.

[Richard leaves the table.]

RICHARD:
This is Maxwell.

KIMIKO:
Richard! They let you have your cell phone in jail?

RICHARD:
Umm, no. I'm out on bail.

KIMIKO:
Oh, thank goodness. Lyle and I have been just sick thinking about you.

RICHARD:
I meant to call you both, but things got a little hectic here.

KIMIKO:
No kidding. I've been asking around, but all anyone knows is that the police think you were involved in a fire or something at Campbell College. We know you couldn't have been.

RICHARD:
Yeah. Kimiko . . . I'm just gonna ask. You didn't have anything to do with this, did you?

KIMIKO:
No.

RICHARD:
Uh-huh.

KIMIKO:
Really, Richard. I'd never set up a friend like this. Besides, what do I have to gain from burning down some building? I'm terrified of fire, anyway.

RICHARD:
Yeah, I'm not too fond of it, myself. (A BEAT) Apparently, a computer was stolen from the building before it burned down.

KIMIKO:
I was here in Richfield all that night, just like you! Working on my program!

RICHARD:
Yeah. Well, I believe you.

KIMIKO:
So, do the police have any leads?

RICHARD:
Other than me? No.

KIMIKO:
Well. Do you have any?

RICHARD:
Other than you--no.

KIMIKO:
Huh. Well, if Lyle and I figure out anything, we'll give you a call. And call us if you need to--we're here for you, Richard.

RICHARD:
Thanks.

[Musical transition to: Whit is walking in RICHFIELD the next morning. Richard speaks to him over the phone.]

RICHARD:
It's the really narrow building, with an arched doorway and giant flowerpots out front.

WHIT:
Ah--I think I see it across the street.

RICHARD:
I can’t believe you went all the way to Richfield to check this out, Whit. But I told you, I don't think Kimiko had anything to do with it.

WHIT:
I just want to talk to her and Lyle--see if I can get them to remember anything that might serve as evidence in your favor.

RICHARD:
(A SIGH) I wish I could be there.

WHIT:
I know you would be if you were allowed to leave Odyssey. Now, you said she's on the third--wait a minute.

[From across the street, Kimiko is being escorted out of the building by the police; Lyle follows.]

KIMIKO:
(SHRIEKING) What is this? This is outrageous! You can't take me there without proof!

LYLE:
Sir, there's been some mistake!

[Whit runs toward them.]

WHIT:
Captain Quinn?!

RICHARD:
What's going on?

WHIT:
I'll call you back in a second, Richard.

RICHARD:
Whit--wait!

[Whit hangs up.]

QUINN:
Ah, Whit. You knew about Miss Kai as well?

WHIT:
I might have had some suspicions, but--

QUINN:
Well, you know you should have come to us. No harm done--we still got her.

KIMIKO:
I want to talk to my lawyer! Lyle, call my lawyer!

LYLE:
Quiet, Kimi. Right to remain silent, remember?

KIMIKO:
(FRUSTRATED SOUND)

[In the background:]

OFFICER:
Into the car, miss.

KIMIKO:
Yeah, yeah.

[On top of that:]

QUINN:
We found all the evidence on her computer.

WHIT:
Well . . . well, good. So that means you can release Richard.

QUINN:
Why would we want to release him? We finally have both of the suspects.

WHIT:
What?

QUINN:
Miss Kai was Maxwell's accomplice.

[Commercial.]
