I've been reading the SCOTUS & Gitmo case. And I'm curious to know how important is previous legal case & ruling. I guess my exact question is under what circumstance that strict constructionist judges would make a ruling if he or she confront with a unique case without any precedent.

Say human civilization were gone and we started over from scratch what goods are these strict constructionist judges?
