Prosecutors called it a random act of violence. Megan Leibengood was gunned down in 2004 outside of her Codell Drive apartment. Now, her killers have been convicted. A jury found 17-year old Michael Shepherd guilty of intentional murder, robbery, and tampering with evidence. He now faces life behind bars. The jury also recommended 18-year old Robert Miller spend the next 40 years behind bars. He was found guilty of complicity to murder, complicity to robbery and tampering with evidence.
But, Megan Liebengood's husband says his wife shouldn't have died in the first place. He's now filed a wrongful death suit against the owners of English Manor Apartments in Lexington. The newlyweds moved into the Codell Drive apartment just three months before Michael Sheperd and Robert Miller robbed and killed Megan.
According to court documents, it was soon after the Leibengood's moved into their first apartment togethe that they realized they wanted out of their lease. Eric Leibengood's attorney wrote in civil action suit that the apartment complex was negligent in failing to provide a secure and safe environment for its tenants.
English Manor attorneys countered the claim, saying that the apartment community manager was aware that the Leibengood's were not satisfied and wanted to break their contract and that both Megan and Eric had raised two concerns with the property. They complained of an alledged drunk person driving a car on the grass and also that someone had found a knife on the property's playground. But the worst was yet to come. On September 15th, 2004, sometime before 11 p.m. Megan Leibengood was on her way home from the grocery store, got out her car, started to collect her belongings, when she was attacked, robbed and then killed by Michael Shepherd and Robert Miller. It all happened outside her apartment window.
A jury convicted the two teens of taking Megan's life, but court documents state that Eric Leibengood also faults the apartment complex for not providing a safe environment for its tenants. Stating English Manor apartments' negligence was a substantial factor in causing the injury and death of Megan Leibengood. As for those accusations court documents show English Manor's attorneys deny any responsibility for Leibengoods death.
