New CA cell phone laws July 1st

I feel like a nerd today so I'm sharing all these PSA's with you :) Break out those bluetooths or handsfree devices. I'm guilty of not using my bluetooth. I better go charge that thing up.

Many of you know that as of July 1st 2008, a new cell phone law will become effective. It states:

Adult over 18 years old: 23123 (a) CVC--An Adult shall not drive a motor vehicle while driving a wireless telephone unless that telephone is specifically designed to allow hands-free listening and talking, and is used in that manner while driving.

Minor under 18 years old: 23124 (b) CVC--A minor shall not drive a motor vehicle while driving while using a wireless telephone, even if equipped with a hands-free device, or while using a mobile service device. This section also prohibits minor from texting while driving.

Summary: Any time an officer sees a person with their cell phone up to their ears, it is a probable cause to stop that vehicle. However, officers shall not stop a vehicle for the sole purpose of determining if the driver is a minor (secondary offense).

Exemptions: These sections do not apply to a person using a wireless telephone for emergency purposes, including, but not limited to, an emergency call to a law enforcement agency, health care provider, fire department, or other emergency services agency or entity.

Class A and B drivers driving a commercial vehicle, tow trucks drivers, and bus drivers may use a 2-way radio and/or push to talk (Nextel type). The vehicle codes allow adult to text while driving. However, per the California Highway Patrol (who would cite their own mothers), dialing and texting while driving is considered unsafe and therefore could constitute a violation of 22350 CVC--Driving at an Unsafe Speed for Conditions.

Punishment: No point on your driving record

First Violation: $73.00
Each Subsequent Offense: $181.00
