I doubt it for the key blade, but that would largely be because it's... well, a key. Something a bit more swordy might be different.

I believe you would have to, if it's a metal replica. Try talking to your local SCAdians (there's usually a few running around at the Meeting Point), they'll probably have some good ideas about what kind of permit you need.
