Got one thing to say.

OUCH!

What manner of legislative and mental failure in the Oklahoma government resulted in that law being passed and signed in the first place. The ESA and EMA tore that law limb from limb in that brief, if the judge rules anything but Unconstituional, he should be removed from office for Judical failure.

Regardless, I'd love to see one of these laws get to the SCOTUS, and end this stupidity once and for all. But god help me, That this law was passed at all has nearly destroyed my faith in the american system of government.

I'm certain that the judge can rule mootness instead of unconstitutional. If violence is so pervasive that it serves as a thread holding the plot of the material together, it probably has at least some literary value. I think that MacBeth, Hamlet, and several similar plays already demonstrated this...

That would basically require the judge to rule in favour of the state, which would mean that the devil should know how to skate.

If the judge overturns the law, can't the state government appeal to a higher court? Isn't that what the Minnesota AG is doing now?

but wouldnt that law simply get shot down again at the higher court and thus wasting more money. Its akin to getting all your limbs chopped off and then wanting to continue fighting.

As far as the brief goes, they could really just photocopy it and then pull one out when a new law pops up since most are carbon copy clones each other anyway with only a few differences, but so small it might as well be said its the same as the rest

glad someone picked up on that joke, even though thats probably the best thing I can compare the MN appeal to with the ESA being the King and MN being the Black Knight after losing the first court battle. If that wasn't a constitutionality issue, I can see an appeal possibly happening. But it was deemed unconstitutional on good reasons, yet they want to appeal to higher courts and continue a fight they have already lost.
