There was a radio host from Illinois I think it was who tried to sue XM saying they should have to follow the same censorship restrictions as public radio stations. The case was thrown out due to lack of merit if I recall correctly. I have XM, and you want to know the big difference between XM and publicly available AM and FM radio stations? I pay $10 a month for XM so that I can hear the curse words in my songs. End of story. As much as I think Howard Stern is a dope, he's on Sirius now, and people are paying $12 a month to hear him say "I love fucking titties" without being bleeped. There is no debate.

That and the only reason the FCC has jurisdiction over content of radio stations is because the radio frequencies are licenced from the FCC and anyone with a radio, no account needed, can tune in, so there's no possibility of parental control (they can't just cancel the account, for example). Which is why cable channels like HBO get away with much more than broadcast channels. And also why the Playboy channel and PPV can air porn.

Its also why South Park is still on the air, and can manage to say "shit" 146 times in one episode.
Also why Comedy Central can air South Park: Bigger, Longer and Uncut unedited. People have tried to get South Park off the air numerous times, and the FCC has said it has no jurisdiction over subscription based Channels. The Courts have ruled that Congress has not granted the FCC this jurisdiction and the granting such jurisdiction could potentially bring up First Amendment questions.
