OK, I just heard this story this morning on the radio on my way to work, and I have to share it with you:
A few weeks ago, Josh Hancock, a major league pitcher for the St Louis Cardinals, died in a car crash at night. He was drunk (more than 10 beers), they found 8 oz of pot in his car, he was talking on his cell phone to his girlfriend about being on his way to another bar, he was doing 70 mph on a 50 mph road, and he did not have his seat belt. What he did was colliding into a stalled car on the road that was being towed.
Now, Josh Hancock was a known alcoholic, a regular in a bar owned by a former Cardinals player. A few days before the crash, he even missed a game start because he overslept, due to a huge hangover!
Now, the news this morning is his father wants to sue:
- the bar (for serving too much alcohol to his son and not stopping him from taking his car, apparently he could not reach a cab)
- the towing company (supposedly not visible enough, though some police reports say all the appropriate lights were on. Apparently, it took them too long a time to remove the car from the road.)
- the owner of the stalled car for letting the car in an improper location...!!!
How more ridiculous can it be?? What about suing the cell phone company then? or, the state of Missouri for their narrow lanes?
I mean, come on! It is tragic all right, but who is the victim here? Isn't there a little responsibility to be shared? Did some person involved acted a little immaturely? Last time I checked, you drink and you drive was a no-no. And when you have your own car keys in your own hands, it is your decision to drive or not to drive.
