Pretty sure that even if its free, the owners of the IP can sue, even if all they do is keep the project from ever going public.

too late to prevent it from going public. They can issue take down notices, but because that are not really rights holders it might not work. Its going to be an interesting legal battle for sure, Tolkien's estate has a claim, as does who ever holds rights to the movies since the character likenesses are so dead on, but this is an original work, no money being made, so no pockets to dig at.
