this is what I wrote on Better Business Bereau:
Starting on Sunday 9-28-08 I e-mailed O'Connor Chevrolet stating that I was interested in a White 2006 Chevy Cobalt LS which price was approximately $9,995. On Monday 9-29-08 I went to the Auto dealer perusing my interest in this car to test drive it. I liked how it drove but it was not exactly what I wanted because the lack of accessories. Bill Simpson then advised me to a car close by which was a Red 2007 Cobalt LT which I believe was $13,500, which was perfect for me, it had everything I wanted. That night around 7:30 PM I returned to the dealer after about 15 minutes of thinking. Bill Simpson wrote up a contract for the 2007 Cobalt. There was no discussion between us about needing a cosigner, about what types of loans were available or even an in-depth discussion about my current credit. All that was discussed is that I was a first time car buyer who was currently establishing a line of credit. That night around 8:00 PM I paid a $200 down payment on the 2007 Chevy cobalt, expecting that it would soon be my car. The next day, Tuesday 9-30-08 I got a call from bill saying "Sorry but your credit has not been approved for the 2007 cobalt but it has been approved for a 2009 cobalt." That night around 5:00 PM I went to the dealership to talk to Bill about the situation. He said that I was approved for the 2009 because I am on a new car buyer loan, which again there were no other options given to me for other loans. He told me I did not make enough money to purchase the 2007. I test drove the 2009 that night and thought it drove the same as the 2006 and 2007 cobalt. Now the price has again increased to a total of about $17500 for the 2009. Being a naive 20 year old female I felt very pressured by the sales people and thought that this was the only way I could purchase a car (through a new car buyer loan). I signed all the papers that night of 9-30-08 and drove it of the lot that night with out having the car waxed and with a full tank of gas because they were eager to get it off the lot because it was the end of the month. That night around 9:00Pm I became very upset that I just had bought a car that I really could not afford. A call was made to Bill at that time to ask if there was any way I could return the car. Bill told us that it was now my car and there is no way of returning it, that I would have to wait 13 months after I build my car credit up and then he could see what he could do for me. 10-2-08 I returned to the dealer at noon with my mother and father to discuss with the manager what options were available for me to return my car because I am very unhappy with the finance options that were available to me. The general manager said there is nothing that can be done besides reducing the monthly payments back to $328 a month by taking off the extended warranty. After calling GMAC I discussed the situation and asked them if they could specify my options of taking back the car, GMAC said if both parties agreed the contract can be cancelled. The GM told GMAC over the phone he was not willing to cancel the contract. After the dispute ended, later that night at 5:00 PM I returned to the dealer and requested my full tank of gas that I was promised and also requested a copy of the denial of the financing of the 2007 cobalt. The letter that I had been given was dated 10-2-08 on a O'Connor Chevrolet letter head, which should have been written on 9-30-08 which was supposedly the day of the denial. I further asked if they could supply me with the bank that had declined my credit. I spoke with the Finance manager more in depth on this situation and he stated there was no bank involved because he had not submitted the 2007 purchase offer.
After the discussions with the General Manager and Bill at noon they continually repeated that I had been declined the loan for the 2007 and that I did not make enough money which does not go along with what the finance manager had said later that night, because my finance application had never been submitted. As a consumer I believe that their business practices have been deceiving and made me believe that this is the only way I could purchase a car. I find it questionable that they could find a loan for me for a $18,000 car but were unable to finance a $13,000 car.
At this point I would like to cancel the purchase without penalty.
On top of that- I asked where my trade in car my 1999 oldsmobile cutlas was... they had no idea, and were avoiding the subject. My mom and I refused to give the title and registration to them, which means with this car they can do nothing but forge my/my moms signature for the title that they plan to find a copy of.
