I have a question about your scenario. Why do you not hold the man responsible for his actions? He is the individual who (presumably) stripped and (certainly) penetrated his victim. It seems like you are saying a man can't be expected to refrain from having sex, that a man somehow can't control his penis. Just because a woman is unconcious doesn't mean she is there for the taking; if it did women everywhere would be afraid to sleep o.O. Or are you suggesting that the girl in question is awake and aware of what is happening? I think what confuses most people by your scenario is the implicit suggestion that a man would OF COURSE have the the right to have sex with a woman and, dang it all, it's not his fault if she's not awake to say no.
