The "escaping with ease" part of your argument is a fallacy. Unless the Malnosso intervene, which usually doesn't bode well for the subject of their interest anyway, it is extremely difficult to escape from the cells which have been formed in the tunnels, due to the ability-dampening effects. It is true that capital punishment would be rendered largely ineffective, even factoring in the Penalties, but I prefer to avoid that method outside of wartime anyway.
Experiments take place only in the last half of each month. Furthermore, only a select few experiments have caused those who are normally harmless to become threats to the village. Such a defense, while not completely out of the question, would be rarely usable. For example, the latest experiment simply revealed people's thoughts to the world. If anything, that one would have helped in assessing guilt.
As for using trickery to escape, you'd be surprised what well-trained and motivated guards can do to halt such an effort.
Again, though the possibility that the situation you bring up remains, it is low and would only occasionally present a problem. Furthermore, if an experiment is going on, it is usually very quickly recognized as such, and depending on the effects it's reasonable to assume the defensive groups, which, I might add, already exist, will alter their efforts and methods accordingly.

And why wouldn't it? They achieve no advantage from varying the pattern. On the contrary, they are scientists. Patterns, that is to say, the same reaction every time a certain stimulus is applied to a situation, are what they want.
