careyleah and kopernik: ITA--I honestly think that AUs are there already--especially something like an RPF AU.
I know a number of J2 AUs that I seriously wouldn't even cringe if the names were changed and the whole thing was published as is. They are incredibly different from the "source" (which is, in fact sort of an imaignary creation of fandom anyway) and highly evolved worldbuilding. In fact, I told an flist-er as much just two days ago when she mentioned she was going to give it a try. I'd be a little smug that I already read it for free, but hey, depending on the price and my friendliness with the author, I'd considering buying it as a "thank you" to the author even if I never read it again.
dianora2: I'll take your guys' word for it that FSOG is not a good example of that level of reworking, and then I agree that is Not Good, for a variety of reasons. But the main reason is simply because the copyright compensation system is not set up to handle it, not because it's evil to want money for your creations...
I am looking forward to the time when copyright compensation catches up with remix reality.
I don't have any problem paying for clips to put in my vids instead of downloading the source for free. I greatly prefer to pay for it, and do that whenever possible. I'd pay EXTRA to download clips specifically for using in a vid, as long as I could then post it without fear of C&D or takedown notices.
On the flip side, I'd be happy to commission art and fic to my specifications and would be so pleased if there were a way to do this legitimately, by giving some token (fair) fee to the original creators.
In short, I don't think "crossing the streams" would be a problem if there were a way to do it that benefits both the original and the latter-day producers fairly.
But I'm not an expert in the publishing industry or copyright law! I'd be interested in the thoughts of those better informed.
According to a standard plagiarism analyzer FSOG and MOTU are 89% the same. (source)I'd say that indicates a lack of significant rewrites. Whether or not MOTU is distinct enough from Twilight is a more open question and not one I'm particularly qualified to answer as I haven't read it.
phdelicious: Cool, thanks for the info. That's pretty much the same! But yeah, ITA that the real question is how different MOTU is from Twilight. I'd love to see a technical solution to that, but sadly things like that will probably involve lawyers for some time to come, which is probably one of the things that makes the process so expensive.
