http://www.fosters.com/apps/pbcs.dll/article?AID=/20050528/NEWS05/105280070/-1/CITIZEN A New Hampshire Police Chief, annoyed at not being able to get ICE (Immigration and Customs Enforcement) to take custody of illegal immigrants in New Ipswitch, has started arresting them for Criminal Trespass.
The state statute used in New Ipswitch and Hudson states a person is guilty of criminal trespassing if, "knowing that he is not licensed or privileged to do so, he enters or remains in any place."
If this conviction is upheld in court, it would probably spread to common use in many New Hampshire counties, and perhaps in other states.
Of course, the ACLU is crying foul... but they've always been in favor of illegal immigration. They've even hired an attorney to represent a 21-year-old illegal alien that was arrested in New Ipswitch.
IMNSHO, according to the state law, the ACLU should lose the case.
Kudos for Police Chief W. Garrett Chamberlain's thinking outside the box. Yay, team!
