I'm feeling rather sick this morning. And the Apartment mgr shows up saying he wants to do an 'inspection' again. I honestly tell him I'm not feeling well, this is not a good time for to me, but he insists on saying he merely wants to 'talk'. (I was feeling really sick & definitely not in a good position to verbally defend myself, or at least I ( Read more... )

Minor update: (Shandra) and I are awaiting a written response from the landlord right now. (Shandra sent an email asking for a better explanation since I wasn't feeling well & wasn't able to concentrate well enough on the whole conversation b/c I also only had one of my hearing aids in at the time.) But, if what I thought I heard is right, it sounds like another resident is claiming they can smell our dogs, according to the mgr - a claim of being able to 'all the way down the hall' , (which is a little outrageous sounding.)

Unfortunately though, the landlord has a clause in the pet license/lease contract addenum that allows them to revoke the license based upon such complaints.

I find it interesting there's the word 'reasonable' cited in that part, which made me wonder exactly where we stand on this b/c a couple of our didn't report a odor issue, which strike me as a 'they say this and we say that' situation.

After I talked with an advice hotline, I was informed that if they revoke our pet license (which is an addendum of the rental lease agreement to allow us to have our pets) and we can keep our dogs, but then we're supposedly in violation of the apartment rental leases main portion which specifically states that *we can't have pets*, and therefore the landlord can start eviction proceedings on us. While we can technically challenge it (the reason-ability bit of clause) in court, but it's one heck of a gamble on whether the landlord can successfully argue his side to the judge, and if the landlord wins, the judge will almost certainly rule for our eviction.

And here's the kicker - There's yet another clause in the lease that says we're both individually responsible for paying for the rent amount for the remainder of the leases term, if we get evicted! [Now ain't that a sweet sounding business profit motive for evictions?]
