Seems the NYPD, led by a Deputy Commissioner who happens to be ex-CIA, wants to eliminate that whole pesky First Amendment protection thing. Specificially the bit about actually investigating criminal activity and expanding its scope to investigate anyone - most specifically, anyone who happens to disagree with the current Regime.

I am not convinced that this hearing taking place the day after Shrub's warmongering "forget the state of the Union, let's kill those bastards" speech is a coincidence. Of course, I got to see people arrested for "conspiracy" based on the fact that they were wielding cellphones, so my assessment on the health of the Constitution isn't great.
