Let's Break Things Down About Genocide...
I have always found it odd that it is often so easy to prove that someone has committed murder, but so difficuilt to prove that someone has commited genocide.
I mean, it's like: "Hmmm, there were 50,000 people here a few days ago, and now there's a mass grave with 50,000 bodies in it..."
Of course that's oversimplfying it, but I mean, come on! Plus, after you've been convicted for killing 1 person, or 2 people, or 10 people, how much worse can the sentensing for a conviction get? I mean, I'm gonna have to go ahead and say that if you've been found guilty of killing 10 people, the punishment can't be a heck of a lot worse than if you're found guilty of killing 50,000 people. I mean, unless you want to coordinate with the Budists, and track down the various reincarnations of a person, you kinda have a finite number of lives. One.
So let's do a quick simulation. (the names have been changed, but the details are pretty darn close to accurate)

The charge: You killed lots of dudes
The proof: Their bodies with your henchmen's bullets in their chests, and your cronies gas particles in their lungs

The plantif's: "On thursday, there were 100,000 people living in a region. The leader of the country did not like the people living in this region. The leader of the country has death squads (which doesn't say too much about his moral fiber). The leader of the country had 100 chemical weapons. On friday, there were 50,000 people running like crazy from the same region where before there were 100,000. 60 chemical weapons went "missing", and the death squads were seen mowing people down. On saturday, there was this big hole in the ground, full of dead bodies. The leader of the country was grinning (and did we mention he had death squads?)"
The defendant: "On thursday, 50,000 people in a region of my country that I really hate were taking showers. They all slipped."
