The Supreme Court in a 5-4 decision has
upheld the Nebraska "partial birth abortion" ban that has no exception for protecting the health of the woman. This decision completely ignores the past court's rulings in Roe and Casey, ignores the whole concept of viability, and paves the way for broader restrictions on a woman's right to choose. Considering that the technique that is banned is the safest method of terminating later term pregnancies (such as in the case where testing in the second trimester discovers that the fetus is deformed and not viable), and the procedure is medically recognized, as the best alternative in some instances, the lack of a safety exception is unconscionable.
