Stewart, who argued in the Marriage Cases on behalf of San Francisco, put it in the municipal petitioners’ statement to the court, "This Petition is brought on the ground that the California Constitution does not allow a bare majority of voters to divest a politically unpopular group of rights conferred by the equal protection clause."

not determining which groups the majority thinks deserves them...
