I must say I really do love Florida's weather urring the day in this season it jsut makes me very happy well here is smth else for me to be happy about....
Manchester - A jury yesterday awarded $480,000 to a Hooksett woman's husband and children, agreeing that she was fired from her job because she suffered from diabetes and needed a kidney transplant, which boosted her employer's health insurance costs.
Cheryl Sweeney died Nov. 14, 2001, at 38, leaving a husband and two daughters, ages 10 and 14. Her death came three months after she was fired from her job as a junior buyer-purchasing clerk at Granite State Manufacturing.
Her lawyers alleged Allard Nazarian Group, doing business as Granite State Manufacturing, wanted to get rid of unhealthy employees working at its 124 Joliette St. plant in order to keep its health insurance premiums down.
The lawyers for the estate alleged Sweeney was wrongfully terminated six weeks after she told her employer she was going to have to have a kidney transplant and after she went to Wisconsin for medical evaluations.
Shortly after she lost her job, Sweeney was hospitalized for emergency dialysis. On Oct. 28, 2001, she had a diabetic reaction to insulin, suffered kidney failure, fell into a coma and died two weeks later.
Lawyer Richard E. Fradette said Granite State Manufacturing, which had 100 employees at the time, terminated 10 people on Aug. 8, 2001, including Sweeney and a worker who had to take time off under the Family and Medical Leave Act. He said the company then hired six people by Dec. 1.
"They were selecting people they perceived it was in their best interest to get rid of," said Fradette.
Granite State Manufacturing officials denied the charge.
"My client maintains it did not do anything wrong, and we're considering our options," said attorney Robert R. Lucic, who represented the Manchester company.
The case was tried in Hillsborough County Superior Court over 12 days, and the jury deliberated about 12 hours before returning a verdict in the early afternoon.
The jury awarded $55,000 for lost pay and benefits, $155,000 for emotional distress and $150,000 in enhanced compensatory damages for "wanton, malicious or oppressive conduct by the defendant."
Sweeney's sister, Patricia Mitchell, a former Manchester resident who lives in Tampa, Fla., said she choked up when she heard the verdict and was happy that her sister's children will have financial help for their education.
She said jurors "learned the horrible things they put my sister through and the harassment she went through in her last few months.
"What these people did was malicious, that was the most important thing that came out of this," Mitchell said. (from todays Union Leader)
