I know that I have a few lawyers and/or law students on my flist, and I'm hoping that one of you can answer a question for me, or point me in the right direction to finding the answer. For the record, I think that I know what the answer is, but I want to be certain.
Is it legal for a privately owned business to discriminate against who they are willing to serve, and/or what services they are willing to offer, on the basis of whether or not the person has a disability? I am thinking that the answer is, unfortunately, yes, since I've seen many signs over the years reserving the right to refuse service to anyone, but I was just asked this question and wanted to verify before responding.
So, any ideas? The background on this is a restaurant that caters to parents of small children by providing childcare while the adults dine refusing that service to special needs children.
