Judicial review

Oct 22, 2014 15:12

So I did my first grounds of judicial review yesterday, editing and sending them today, with an advice on the merits for the purposes of obtaining public funding.

My solicitors had sent a "pre-action protocol" (PAP) letter a while ago to inform the Home Office of the intention to JR their decision and ask them to reconsider it.

After spending hours working on and producing 22-page grounds, and sending them at about 11 this morning, 30 minutes ago I received a letter from my solicitor, with a new explanation for the challenged decision.

The original decision was made on ridiculous grounds, which were completely open to a JR challenge.

The new letter, which led to me learning some more about the immigration history of one of the claimants, is based firmly based in law and basically destroys the entire basis of the grounds I spent all of yesterday working on.

Great.

At least I got experience drafting JR grounds.

Tomorrow I am officially "off" work (ie, not in court, but likely in chambers at least sometimes) for ten days. Not before time. This is the first more-than-long-weekend I've had off since April. Kit and I are going to Hastings for a long weekend Saturday-Tuesday. I've had a yearning to go there for a good year. I randomly had a court hearing in Hastings County Court and on walking out of the train station, fell in love with the town and texted Kit that I really liked it and would like to stay there sometime. I also hear it caters well for veg*ns.
