I am looking for a book for my 13 year old nephew. He likes Harry Potter and I would like to give him something on the same reading level

I was going to say Percy Jackson or Artemis Fowl, but they're actually written on a much easier level than HP (especially once you get past the first two books in the HP series). A better fit for his age and considerably darker (and very fun because of this) would be the Bartimaeus Trilogy by Jonathan Stroud (beginning with The Amulet of Samarkand) and the Faerie Wars books by Herbie Brennan. He may also enjoy the thirteen (of course!) books in A Series of Unfortunate Events, which are wicked clever and full of hair-raising, suspenseful plot turns and many, many villains who you love to hate.
For your niece I'd say something with an easier reading level that is still challenging intellectually (raises issues that really make kids think): Jane Langton's Hall Family Chronicles, starting with The Diamond in the Window (although my favorite is the second book, The Swing in the Summerhouse). Many of them have been reissued recently after being out of print for years, and there are now 8 books in the series, the most recent one having come out just a couple of years ago (The Dragon Tree). Any of the older titles that you have trouble locating in stores should be easily available second-hand online through A Libris, Amazon or Powell's. Laura Ingalls Wilder's Little House books are also a perennial favorite with girls her age, although I get the impression they never made much of a dent with boys.
