California is upholding Prop 8.

You know, I've been wanting to comment on this for the last couple of days. So. Yeah. I guess I'll put my foot in my mouth here instead of elsewhere.

Proposition 8 was a legally passed amendment to the state's constitution. How could the state Supreme Court not uphold it? What point could they use to make it illegal? It's certainly not unconstitutional because it's part of the constitution.

As I remember the numbers, it barely passed. It's going to go away in the future. The people who were married before it passed have their marriages upheld.

It's immoral and stupid, but it is legal at the moment. I, for one, am more uncomfortable with the idea of state Supreme Courts being able to nullify parts of a state's constitution as they see fit.
