Title: Defense AU

Disclaimer: It's all true, just not in this dimension. If anyone finds a portal to the one it IS true in, please let me know!!
Feedback: It's what makes me want to keep writing. I want it, bad or good! PLEASE!
A/N: I really don't know all that much about what goes on in a courtroom so forgive me silly little mistakes. This story was meant to be a very short story with a bit of a plot and ended up growing and growing and growing so I am drawing out things I'd intended to only skim over. It still moves a little fast if you ask me though. I almost feel like I'm not doing Kevin and Nick's relationship justice. Any thoughts on that?
A/N 2: *******shameless plug alert****** This has nothing to do with the story but I am compiling a book of gay erotica geared more towards women then what's out currently. It may only be something fun to create and pass around to the participating writers, but I would like to see it published. If you write ANY kind of gay erotica (male) and would like to either submit something or assist me in its creation, contact me at tarissa521@yahoo.com.

CHAPTER FIVE
The file had sat on the corner of his desk for three hours now and he refused to allow himself to grab it and flip open to the pictures. He wouldn’t do it. He was the partial owner of a large firm, a professional man in his mid-thirties. He was not some horny teenager or even a college student any more who could sleep with anyone he wanted and not have to face the consequences.
He’d slipped out of the apartment before Nick even woke up that morning, leaving only a note with simple instructions that basically told the actor to let himself out. Kevin had been in such a hurry to avoid any confrontation that he’d even showered at the gym on the way to work instead of at home. He was being a coward, he knew, but the truth was that he had truly enjoyed that night and he couldn’t get Nick out of his mind no matter what he did and that scared him. He didn’t like that feeling that he couldn’t just shake off. And perhaps a part of him was worried that if he saw Nick face to face he wouldn’t be able to say what needed to be said.
He’d done a good job of avoiding the blond all week, even though Nick had needed to come to the office multiple times to meet with Brian. Kevin would always be gone already or on his way out. He’d actually thought that Brian had completely failed to notice his strange behavior until Nick’s folder appeared on his desk with a less-than-cryptic note. ‘Court on Monday at 8:00. I expect you to be there.’ He’d sighed. If only Brian knew, then he’d be willing to let Kevin stay as far from Nick as he could. However, Brian couldn’t know because Kevin couldn’t bare see that look of betrayal on his face. Not again.
***************************************************
He’d better never be called a bad lawyer or a bad friend, that’s all Kevin had to say as he snuck around paparazzi and media to get into the packed courthouse. He actually had to go through a metal detector and give his ID three times just to get up to the courtroom! How ridiculous. All of this over one young man. One very good-looking man with soft blond hair and a long cock Kevin could still taste in his mouth.
Good job, Kev! Thoughts like that are definitely going to keep him off of your mind. Right. He couldn’t help it. He didn’t know why he couldn’t help but let his mind fall to the gutter practically every time the name Nick Carter was mentioned, but it happened. He also couldn’t help the guilt he felt right now, both at seeing Nick face to face after blatantly ignoring him and at seeing Brian knowing what he’d done.
If Kevin thought the courthouse as full, the courtroom was overflowing. There were families and friends of Nick’s to show support, even a few famous faces. There were bodyguards and court officials and press. He couldn’t even identify what purpose half of the crowd served, and this was definitely a bit of a circus. He hated celebrity trials. Kevin found a seat near the front on the Defense side, looking around for signs of either Brian or their prized client. They were nowhere to be found and for a moment he worried. Brian was never late to a trial and certainly wouldn’t be to one as important as this. California VS. CARTER was the biggest case of his entire career. He then realized that Brian was probably running over things with Nick one more time and briefing witnesses if they had any today. He had been paying so little attention to the case (purposely) that he wasn’t even sure if Brian was going to have Nick testify. Kevin thought he should because Nick was good-looking, well-spoken, and intelligent and would only make himself look good if they prepared him well enough. Nick wasn’t his client though and this wasn’t his case. So why was he so damned nervous?
A hush fell over the crowd and cameras whizzed over to the door. A moment later it pushed open dramatically and in walked an impeccable Brian right next to the tall, handsome, amazingly, gorgeously, cleaned-up Nick Carter in a dark suit with a blue shirt under it that matched his eyes. Nervous-looking, ocean blue eyes that scanned the crowd and then locked on his. For a moment the rest of the courtroom disappeared and only Nick existed in all the world. Kevin had the urge to stand up and walk over to Nick and hug him. To do anything he could to tell the actor that it as all going to be okay. And then the blue eyes pulled away as Nick and Brian began a slow march down the aisle -cameras clicked and the necks cranked to watch them - and it all came zooming back into focus. What was this kid doing to him?
He was surprised when Brian stopped at his aisle and motioned for Kevin to join them. He started to refuse, but there were cameras everywhere and it wasn’t the time to be seen disagreeing with his partner, no matter how minor the issue. He stood and smoothed his own suit and followed the two men, taking a seat to the far side of Nick so that their client was sandwiched between them. Brian leaned around the blond. “I want your help,” Brian explained and Kevin only gave a curt nod in response.
The first part of a trial is a lot of legal mumbo jumbo that most of the civilians watching have absolutely no interest in. Unfortunately, as abruptly appointed second-council, he was forced to take an interest and was busy paying attention when he felt a warm leg move to brush along side of his own. When it didn’t move, Kevin moved his. A few moments later the other leg was back. Kevin sighed loudly enough for Nick (who hadn’t so much as looked at him since they sat down) to hear it, and moved his leg again. He wasn’t going to play footsie like some 14 year old and he sure as hell wasn’t going to do it in a courtroom. Nevermind that his pulsed raced just a little faster at the proximity to the blond who had invaded his thoughts all week long.
They weren’t released for a break for five whole hours, this being a celebrity murder case it took that much more work on each side and both the Prosecution and the Defense were busy trying to get each others cases thrown out before they were even made. It wouldn’t work, but it was generally standard practice to try just in case. The entire five hours he’d spent at Nick’s side fending off the miniscule touches and brushes until again he just gave up and let the actor keep their legs pressed together and their hands side by side on the table.
When a short twenty minute recess was finally called Brian stood and let them know he was heading to the bathroom. Kevin took that as his chance to call Nick on his highly inappropriate behavior that morning, standing up and motioning with his head for Nick to follow him. Kevin led the way out of the courtroom and into the first empty conference room they came to, shutting the door behind them.
“That needs to stop, Mr. Carter,” Kevin said, folding strong arms across his chest.
Nick looked at him with the hint of a grin. “What does, Mr. Richardson?”
He stepped closer to where Kevin was standing and reached a hand out, running his index finger down the length of Kevin’s set jaw. Kevin’s jaw ticced and he took a step backward. “That, Nickolas! I am your lawyer, officially now. There is absolutely nothing between us. What happened the other day was a huge mistake and you can rest assured it will not happen again.”
Nick stepped forward to match Kevin’s retreat and looked into his eyes, blue eyes seeming to bore into and engulf the green ones. “What if I won’t take no for an answer?” Another step. “What if I know that that night was just as amazing for you as it was for me and no just isn’t good enough?” Another so that now their bodies were bare centimeters apart. “What if I won’t accept the ‘it’s a mistake and won’t happen again’ line?”
“You have no choice,” Kevin said, cursing the way his voice wavered and refusing to attribute it to Nick’s proximity.
Nick’s hand reached out to cup his jaw, following as he tried again to pull away. The other hand was brought up and Nick pulled his face close to Kevin’s. The lawyer found it surprisingly difficult to keep refusing the touches his traitorous body was craving so much. His eyelids lowered when Nick whispered close to his face. “I think I do, Kevin. Look at me and tell me you don’t want me.”
“I don’t want you,” Kevin said immediately.
“No! Look at me, Kevin. Look at me for real, and tell me that you truly feel, deep down, that what we did was a mistake.”
Nick had the most amazing blue eyes. Sometimes the blue was deep and dark and other times it reflected the turqoise of the shallow water over a coral reef. They were so expressive, and they had the ability to trap him. Kevin found he could not bring the words to his lips again, despite how hard he tried.
He closed his eyes to block out Nick’s and shook his head. “We can’t, Nick.”
“Yes, we can.” And then he felt the hot, soft lips moving assuredly against his own, drawing his blood pressure to a faster rate, and getting a response from him despite himself.
His arms unfolded and slipped around Nick’s waist, pulling him flush against Kevin’s body and getting the smallest hint of a moan from the blond. The sound only made him hold tighter, and when Nick’s tongue probed for him to open his mouth, he did so without hesitation. Kevin lost all track of the world around them as he fell further into the sensation of Nick against him, his mouth caught up in a sensuous dance with the actor’s. He didn’t even register the door opening, and only heard the seemingly distant voice say, “Are you guys in-“
It was Nick who jerked around and smiled sheepishly at his lawyer. Kevin, dazed, followed dumbly a few tense moments later as Brian Littrell completely ignored his client to stare with frank and open hurt, and confusion on his face. Kevin opened his mouth to say something and Brian gave a short shake of his head and turned and fled the room.
“Brian!” Kevin called after him, but the younger lawyer didn’t stop.
