Because, for every law person who argues that fanfic is illegal, you can find another one who will argue how it is likely protected under the fair use clause. Which is why I get annoyed when people boldly state that fanfic is "clearly illegal". Hey, say "possibly illegal". Say "almost certainly illegal" if it makes you feel better. But this isn't a clear-cut case, at least not until there's some legal precedent (and neither side is interested in becoming the test case ... at least on that point everyone seems to agree). Michael Lovitz at Comic Con's "Comic Book Law School" seminar always emphasizes that IP law is so complex that a very common answer you'll get from a lawyer is "maybe".
Shadowkat's post is also quite interesting from an artist's perspective, no matter whether you're a pro or fan artist.
