So, I love my torts professor dearly. I'm sure I've mentioned his Frizzle-esque ties. His dry sense of humor. And the fact that he assigns this as part of a judgment about strict liability for a man who ran over another man's donkey in 1846 we read:

The groans, ineffably and mournfully sad, of Davies' dying donkey, have resounded around the earth. The last lingering gaze from the soft, mild eyes of this docile animal, like the last parting sunbeams of the softest day in spring, has appealed to..the hearts of men. There has girdled the globe a band of sympathy for Davies' immortal 'critter.' Its ghost, like Banquo's ghost...

The donkey of strict contributory negligence will never die! Remember!
