The Re-determinations issued by the Agency concerning the claimants against PS&E are herby reversed.
The Claimants are NOT disqualified for misconduct
The Claimants do NOT owe restitution to the agency
The employer has failed to justify the termination of the employees
The employer has also failed to establish the employees willfully and intentionally
Did anything to establish a complete disregard of the employers interest.
Therefore the claimant's separation is under non-disqualifying circumstances.
-Court date: October 6th
-Decision: October 7th

They have till November 7th to make an appeal
So I won't be fully at ease until then
