tl;dr

(I apologize in advance! I took your comment and had a debate with myself, mostly because I'm feeling insomniatic right now.)

I guess it is, depending on your definition of rape/non-con vs. dubious consent situations. If you define rape strictly as: an assault by a person involving sexual intercourse with another person without that person's consent, which is the strict dictionary definition, then this absolutely is. This usage assumes that any situation wherein the participating people cannot/do not explicitly state their consent is rape. And it's a perfectly understandable position (and, in RL, the one I would apply to most situations).

There are, however, other standard definitions of rape:
- Sexual intercourse without the full and free consent of both parties, either thru force, altered mental state (drugs), or age or maturity issues of a character.
- Forced, unwanted sexual intercourse; about power, not sex.

Using the first definition, this is also rape, but the definition itself is one most people wouldn't call rape.
