Thirteen members of a family are suing the operator of a Pizza Hut for $2 million, alleging they were refused service because they are black. "Alls we wanted was sum pizza, then they say "We ain't gots nones." And they wouldn't give us no pizzas. It was plain as day, they was racist! said Tabitha Wells enraged from lack of service.

Colonial Foods LLC maintains that employees tried to explain to the family that they couldn't be served because the restaurant had run out of cheese and couldn't make any more pizzas. "It was a cheese issue, not a race issue," said Tim McConville, an attorney for the company. The lawsuit was filed June 24 in Circuit Court on behalf of Shonda Talley-Green, Lacondom Talley, Tabitha Wells, Louis Martin Sr., Paulus F. Brown Sr., Shauntral Brown and seven children.

The lawsuit contends the family members saw only white people in the restaurant on the night of June 25, 2000, and were refused service. "We was the only blacks up in there. I axed the lady in charge if this was a racist restaurant, she says "Naw." Then I says "Why only white folks get pizza up in here then!" This is racist discriminations! I wants me my two million dollars!"

"They were rudely told they couldn't be served, or words to that effect," said Michael Heath, their attorney. "They were denied seating at a public restaurant based on their race." Colonial Foods operates 110 Pizza Huts. The case was settled out of court for a year supply of pizza and orange drink.
