People have often passed around episodes of old shows on VHS tape; this is just the modern incarnation. For the most part cost-recovery is an understood implication, and TBH I doubt a TV network would come down on fans circulating DVDs of VHS transfers considering it hasn't been syndicated in - what? a decade?
It's still considered illegal. The FBI warning all over the dvds and vhses clearly state that it is copyrighted material and that you could be fined for it. Which is why they crack down on piracy and those making copies in the theatres, or burning them offline.
(I'm not judging, I'm stating a fact. I've also bought bootlegs off ebay, and then the asshole that I bought them from got mad that I reported him for crapass service because he cost me 60 dollars for cheap bootlegs. And then when I offered to return the dvds he said not to bother, then bitched on my user profile about how I got my refund and to keep the dvds! Thank god at least two of the seasons are on dvd now.. Not that I have even opened them..)
